Who signs for you when you cannot be there?

Who will sign for you at the bank, the land office or the car dealer if you need a power of attorney in Kenya but live thousands of miles away? That question keeps a lot of people awake.

You trust your brother. You trust your old friend from school. Yet trust alone does not open a file at the land registry or close a sale.

A power of attorney in Kenya is the legal paper that lets someone act for you. Done well, it saves you flights, leave days and stress. Done badly, it can cost you a plot.

OnGround Africa is your person on the ground in Kenya. We coordinate the whole process with a licensed Kenyan advocate so your power of attorney is drafted, signed, registered where needed and used correctly.

We are not lawyers and we never give legal advice. We bring in a licensed Kenyan advocate for the legal work. We handle the running, the paperwork trail and the follow up.

Why people get this wrong

Many people download a template, sign it at home and post it to a cousin. Weeks later an office rejects it, or worse, it is used for more than they intended.

A power of attorney in Kenya is powerful. It deserves the same care as the property or money it covers.

What is a power of attorney in Kenya?

A power of attorney is a written document in which you, the donor, give another person, the attorney, authority to act for you. The attorney does not need to be a lawyer. It can be a relative, a friend or a professional.

The document says what the attorney can do and for how long. It can be narrow or wide.

Specific power of attorney

This covers one task or a short list of tasks. Nothing else is allowed. For example, selling one named plot, collecting one title deed or closing one bank account.

Most people abroad are safer with a specific power of attorney in Kenya. It limits what can go wrong.

It is also easier for offices to accept. A clerk can see at a glance that the attorney is acting within the task you named.

General power of attorney

This lets the attorney handle most of your affairs. It is useful if you are away for years and have rent, bank accounts and property to manage.

It also carries more risk. The attorney can act on almost anything in your name.

Your advocate will talk you through whether a general power of attorney in Kenya is wise for your situation.

Who is who

  • Donor: you, the person giving the authority
  • Attorney: the person you appoint to act for you
  • Advocate: the licensed Kenyan lawyer who drafts and checks the document
  • OnGround Africa: the coordinator who handles the running in Kenya

When do people abroad need a power of attorney in Kenya?

Almost always, the reason is property, money or papers. Here are the cases we hear most.

Picture a nurse in Ireland who wants her mother to collect rent from two bedsitters in Ruiru. Or an engineer in Berlin selling a plot in Kitengela. Both need a power of attorney in Kenya, but the wording for each is very different.

  • Selling land or a house while you live overseas
  • Buying land and signing transfer papers through a trusted person
  • Managing rental property, collecting rent and signing leases
  • Handling a bank account where the bank allows an attorney to act
  • Transferring a car where more than online steps are needed
  • Company matters such as signing for a director who is abroad
  • Family estates where someone must deal with offices after a death

Each of these needs a different wording. A power of attorney in Kenya that works for a bank may not be enough for the land registry.

That is why we always start with the end in mind. Which office will see the document?

What exactly must the attorney sign? Your advocate drafts your power of attorney in Kenya to that answer.

If your goal is buying land, read our guide to buying land in Kenya from abroad first. If it is a car, see our NTSA logbook transfer page.

How does a power of attorney in Kenya get made from abroad?

The steps are clear once you see them laid out. Here is the usual order when we coordinate a power of attorney in Kenya for someone overseas.

  1. Free first chat. You tell us the task, the attorney and the office involved.
  2. Written quote. We send our fee and the advocate’s fee before anything starts.
  3. Advocate drafts. A licensed Kenyan advocate prepares the document to suit your purpose.
  4. You review. You read the draft and ask questions. Changes are made until you are happy.
  5. You sign abroad. Usually before a notary public or at a Kenyan mission, as your advocate advises.
  6. Original travels to Kenya. By tracked courier to us or the advocate.
  7. Registration where needed. The advocate handles registration at the correct registry.
  8. Use. Your attorney uses the document for the agreed task. We keep you updated with photos.

You never need to fly home for this. A power of attorney in Kenya can be built entirely around where you live.

Signing at a notary where you live

Your advocate tells you exactly how the document should be signed and witnessed. In many countries that means a notary public. Some people use a Kenyan mission instead.

Take your passport and the unsigned original. Do not sign before you are in front of the notary, since an early signature can make the document useless.

Once signed, photograph every page and send the photos to us on WhatsApp. Then courier the original by a tracked service. We confirm the moment your power of attorney in Kenya arrives.

What you need ready

  • A copy of your Kenyan ID or passport
  • The full name and ID details of your attorney
  • Details of the property, account or vehicle involved
  • The name of the office that will receive the document

Does a power of attorney in Kenya need to be registered?

In many cases, yes. Registering a power of attorney in Kenya creates an official record and is often needed before an office will accept the document.

Kenya’s Registration of Documents Act sets a two month window for documents that must be registered. Section 9 says such a document shall be registered within two months after execution. Where it is signed outside Kenya, the Act says the two months run from its arrival in Kenya.

That detail matters for anyone signing a power of attorney in Kenya from abroad. Do not let the original sit in a drawer after it lands.

Your advocate confirms whether your document must be registered and where. For land matters, the advocate also checks what the land registry under the Ministry of Lands expects.

Why registration protects you

  • Offices can confirm the document is genuine
  • There is a clear record of what you allowed
  • Later disputes are easier to settle with a registered paper

We track the registration step for you. You get a photo of the stamped document once it is done.

Copies and certified copies

Many offices keep a copy of your power of attorney in Kenya on their file. Some want a certified copy rather than the original. Ask the advocate to arrange enough certified copies so the original stays safe.

Using a Kenyan power of attorney overseas

Sometimes the flow runs the other way. You sign a power of attorney in Kenya. It must then be used in another country.

In that case the document may need authentication. Kenya’s Ministry of Foreign Affairs lists powers of attorney among the papers it authenticates.

The ministry’s page says a power of attorney must be notarised and come with a letter confirming the notarising advocate’s status. It names the Registrar of the High Court as the certifying office and lists a fee of KSh 500 per copy.

Documents go in at Counter 39, Huduma Centre, City Square in Nairobi, on Mondays, Wednesdays and Fridays at 0900hrs. The ministry says processing takes within two working days.

We can do that run for you. Read more in our guide to apostille and authentication in Kenya.

Ask the receiving country what it needs first. Some want only authentication. Others also want their own embassy in Nairobi to stamp the power of attorney in Kenya before it travels.

How do you choose the right attorney?

This is the most important choice in the whole process. A power of attorney in Kenya is only as safe as the person holding it.

Good signs

  • They live in Kenya and can reach the offices involved
  • They have no personal interest in the property or money
  • They answer messages and keep records
  • They are happy for us to send you photos of every step

Warning signs

  • They push for a general power when a specific one will do
  • They want the original document kept with them for years
  • They get upset when you ask for receipts or proof
  • They have money troubles that the property could solve

You can also appoint two attorneys who must act together. Your advocate can explain if that works for your power of attorney in Kenya.

Should the attorney know the plan in advance?

Yes. Talk to them before the advocate drafts anything.

A power of attorney in Kenya works when the attorney understands the task, the limits and the timeline. Surprises help nobody.

Some clients ask us to be a neutral pair of eyes rather than the attorney. We visit, photograph and report on what the attorney does. That gives you peace of mind without handing us legal authority.

Can you cancel a power of attorney in Kenya?

Yes. A power of attorney in Kenya can usually be revoked. Many clients plan for this from day one.

Revoking a power of attorney in Kenya is a legal step, so your advocate handles it. In general it means a written revocation, telling the attorney and telling every office that holds a copy.

Where the original was registered, the revocation is usually registered too. Your advocate confirms the steps.

Build in an end date

A neat trick is to set a clear end date or tie the power to one task. Once the plot is sold or the account is closed, the authority ends.

This is far simpler than chasing a revocation later. Ask your advocate to build it into your power of attorney in Kenya from the start.

Keep a list of where copies went

We keep a simple log of every office that received a copy. If you ever revoke, we already know who must be told.

The log notes the office, the date and the person who received your power of attorney in Kenya. It sits in our WhatsApp chat with you, so you have it too.

Common mistakes with a power of attorney in Kenya

We see the same errors again and again. Most of them are easy to avoid once you know them.

Using a foreign template

A form from a website in another country may not suit Kenyan offices. A power of attorney in Kenya should be drafted by a licensed Kenyan advocate who knows what local registries expect.

Wording that is too vague

Phrases like “handle my affairs” can mean anything. Offices may refuse them, or an attorney may stretch them. Name the property, the account or the vehicle clearly.

Names that do not match

Your name must match your ID exactly across the document, the title deed and the bank records. One missing middle name can send a power of attorney in Kenya back for correction.

Forgetting the original

Most offices want to see the original or a certified copy. A scan on WhatsApp is not enough. Plan the courier from day one.

No end date

An open ended power keeps working long after the task is done. Tie it to a task or a date wherever you can.

Letting it sit unregistered

Where registration is needed, the clock starts when the document arrives in Kenya. We log the arrival date and remind the advocate so your power of attorney in Kenya does not miss its window.

Not telling the family

Family members who are left out sometimes block a sale or a lease later. A short call before signing saves months of argument.

We quote in US dollars. Our fee covers our coordination work. The advocate’s fee is separate and shown on your quote before you agree.

Questions people ask

Can I make a power of attorney in Kenya without travelling home?

Yes. A licensed Kenyan advocate drafts it, you sign where you live as advised and the original is couriered to Kenya. We coordinate each step and send you photo updates.

Does the attorney have to be a lawyer?

No. The attorney can be any adult you trust, such as a relative or friend. The advocate drafts and checks the document, but the attorney is the person you choose.

How soon must it be registered?

The Registration of Documents Act sets a two month window for documents that must be registered. For a document signed outside Kenya, the Act says the two months run from its arrival in Kenya. Your advocate confirms what applies to you.

Is a general or specific power safer?

A specific power limits the attorney to named tasks, so there is less room for misuse. A general power suits long absences but carries more risk. Your advocate advises on which fits your case.

Can I cancel it later?

Usually yes, through a written revocation handled by your advocate. Offices holding a copy must be told. Setting an end date or a single task from the start makes this simpler.

Will you act as my attorney?

Not by default. We coordinate the process and can visit and report on what your attorney does. Acting as an attorney would need a separate written agreement and legal advice first.
